Meeting with Attorney Pete Napolitano

Five (5) board members were present including Rhonda King, George Peck, Chad Reid, Ken Spann and Ted Strass when 3 representatives and attorney Napolitano presented their proposal for legal representation.

Attorney Pete Napolitano told the board and those in attendance that his firm was prepared to take both the community law suit and the individual suits for any homeowner who has been damaged buy the flooding. They normally work with sink-hole cases but this is closely related and would require the same experts and tactics. He explained that they work first with the insurance companies to get coverage under existing policies. They then will attempt to prove that a third party was responsible for the water and also go after them (like the county). He quoted a price of 40% fee of the total settlement with expenses coming from our remaining 60%. He said a hydro geologist would be required to prove the case and fees for expenses should not get higher than 10%. (not sure if that is before or after his 40%)

The Board made no decision and will seek other attorneys to make sure that we will get a fair deal and the best representation possible.
